キヤノン株式会社またはそのライセンサーのソフトウェアに関する使用許諾契約

これは、キヤノン株式会社（以下キヤノンといいます。）の製品『Canon LIPSLX/CARPS2 
Printer Driver for Linux V1.80』（以下本製品といいます。）中に格納されているソフ
トウェア（本書添付の別表１に記載されているモジュールをいい、以下本ソフトウェアと
いいます）を、お客様がご使用になるための、お客様とキヤノンとの間の契約です。

本ソフトウェアをご使用になる前に、本契約に記載されているすべての権利および制限を
よくお読みください。

下記第１項記載の態様で本ソフトウェアを使用することにより、お客様は本契約に記載さ
れたすべての条件に同意されたものとします。お客様が本契約の条件のうち、いずれかに
同意されない場合には、本ソフトウェアを使用せず、直ちにこれを入手した場所にご返却
ください。

1.許諾

キヤノンは、本ソフトウェアを本製品においてのみ使用し、使用させ、複製し、複製させ、
第三者に頒布し、かかる第三者に使用を許可するための、個人的、限定的かつ非独占的
権利をお客様に許諾します。（本契約における「使用」とは、本ソフトウェアを格納、
ロードもしくはインストールすること、またはコンピュータにおいて表示すること、
アクセスすること、もしくは実行することのいずれも含むものとします。）
お客様は、本ソフトウェアを自己使用目的の場合に限り、これを変更することができ、
並びにかかる変更物をデバッグする目的に限り、これをリバースエンジニアすることが
できます。
お客様は、本契約と同一の条件の下で第三者に本ソフトウェアを頒布するものとします。

2.制限

本契約において明示的に許諾されているものを除き、お客様は、本ソフトウェアを使用
できないものとし、並びにいかなる第三者にも譲渡、サブライセンス、販売、貸与また
は移転することはできません。

3.著作権表示

お客様は、本ソフトウェアに含まれるキヤノンまたはそのライセンサーの著作権表示を
変更、除去、削除等することはできません。

4.帰属

本ソフトウェアに係る所有権および知的財産権は、その内容によりキヤノンまたはその
ライセンサーに帰属します。本契約に明示的に記載されているものを除き、キヤノン
およびそのライセンサーのあらゆる知的財産についていかなる権利または実施権も、
本契約により、お客様に譲渡または許諾されるものではありません。

5.輸出規制

お客様は、該当国の全ての輸出管理法、規制および規則を遵守するものとし、当該輸出
管理法、規制および規則に違反して、または必要な認可等を得ることなしに本ソフト
ウェアを直接または間接に輸出または再輸出してはなりません。

6.保証の否認および免責

本ソフトウェアは、『あるがまま』の状態で商品性および特定の目的への適合性の黙示的
保証を含め、明示たると黙示たるとを問わずいかなる保証もなく提供されるものとします。
本ソフトウェアの品質、機能およびパフォーマンス、その他についてのあらゆる危険性は
お客様の責任および負担となります。

キヤノン、その子会社、関連会社、それらの販売代理店または販売店、またはキヤノンの
ライセンサーのいずれも、本ソフトウェアの使用または使用不能から生ずるいかなる損害
に対しても、一切の責任を負わないものとします。例え、キヤノン、その子会社、関連会社、
それらの販売代理店または販売店、またはキヤノンのライセンサーがかかる損害の可能性
について知らされていた場合でも同様です。（本契約に言う「いかなる損害」とは、逸失
利益およびその他の派生的または付随的な損害を含み、またこれらに限定されない全ての
損害をいいます。）

適用法において認められる限りにおいて、キヤノン、その子会社、関連会社、それらの販売
代理店または販売店、またはキヤノンのライセンサーのいずれも、本ソフトウェアまたは
その使用に起因または関連して生じたいかなる紛争について、一切責任を負わないものと
します。

7.期間

本契約は、お客様が本ソフトウェアを使用することにより本契約を承諾した時点で発効
します。お客様は、本ソフトウェアを廃棄することにより、本契約を終了させることが
できます。

お客様が本契約のいずれかの条項に違反した場合、キヤノンは、本契約を一方的に終了
することができます。かかる違反により本契約が終了した場合、キヤノンがその法律上の
権利を実施できることに加え、お客様は直ちに本ソフトウェアを廃棄するものとします。

上記にかかわらず、本契約の第4項および第6項から第10項の規定は、本契約のいかなる
終了後も有効に存続します。

8.U.S. GOVERNMENT RESTRICTED RIGHTS NOTICE

The Software is "commercial items," as that term is defined at 48 C.F.R. 2.101 
(October 1995), consisting of "commercial computer software" as such terms are 
used in 48 C.F.R. 12.212 (September 1995).  Consistent with 48 C.F.R. 12.212 and 
48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995), all U.S. Government End 
Users shall acquire the Software with only those rights set forth herein.  
Manufacturer is Canon Inc./ 30-2, Shimomaruko 3-chome, Ohta-ku, Tokyo 146-8501, 
Japan.

本条項で使用される"the Software"とは、本契約で定義される本ソフトウェアを意味し、
指し示すものとします。

9.分離可能性

本契約のいずれかの条項またはその一部が管轄権を有する法域におけるあらゆる裁判所に
より無効であると決定された場合、当該条項はかかる裁判所の法域においては無効とし、
その他の条項は完全に有効に存続するものとします。

10.確認

本契約は、標題に関するお客様とキヤノンの間の完全かつ唯一の合意であり、口頭または
書面にかかわらず、本契約の標題に関する全ての申し出、事前の合意、その他お客様と
キヤノンの間の全ての交信に優先することとします。
